\nThis User Agreement (hereinafter referred to as the \u201cAgreement\u201d) is a public agreement of accession and defines the terms of use of the Create4Me Online Platform (the website create4me.com.ua and\/or the mobile application, hereinafter referred to as the \u201cPlatform\u201d).
\nBy using the Platform, the User confirms his\/her agreement with the terms of this Agreement. If the User does not agree with the terms, he\/she is obliged to stop using the Platform.<\/p>\n
1. General provisions<\/b>
\n1.1. The owner of the Platform is Maksymenko Maksym Petrovych, Individual Entrepreneur, \u0415\u0414\u0420\u041f\u041e\u0423 3494903610, 46027, Ternopil, Prosvity Blvd. 6\/51.
\n1.2. The Platform provides Users with access to functionality for placing and purchasing goods, as well as other service capabilities (reviews, communication, content personalization, etc.).
\n1.3. This Agreement regulates the relations between the Platform and all Users (Buyers and Sellers), but does not replace public offers for each category of users.<\/p>\n
2. Status of the Platform<\/b>
\n2.1. The Platform is an intermediary and provides a technical tool for interaction between Buyers and Sellers.
\n2.2. The Platform is not a seller of goods and is not responsible for:
\nquality, conformity to description or properties of goods;
\nfulfillment by the Seller of obligations regarding delivery, return or warranty;
\nactions or inaction of Buyers or Sellers.
\n2.3. All legal relations regarding the purchase and sale arise directly between the Buyer and the Seller.<\/p>\n
3. Registration and Account<\/b>
\n3.1. To access the full functionality of the Platform, the User must create an account.
\n3.2. The User is obliged to provide reliable data and maintain its relevance.
\n3.3. The User is responsible for maintaining the confidentiality of account access data and all actions performed from his account.
\n3.4. The Platform has the right to block or delete the account in case of violation of this Agreement or the law.<\/p>\n
4. Rights and obligations of Users<\/b>
\n4.1. The User has the right to:
\nuse the functionality of the Platform in accordance with its purpose;
\nreceive information about products and Sellers;
\nleave feedback and comments.
\n4.2. The User is obliged to:
\ncomply with the legislation of Ukraine and the terms of this Agreement;
\nnot post content that violates the rights of third parties;
\nrefrain from actions that may harm the Platform or other Users.
\n4.3. It is prohibited to:
\npost goods and materials prohibited by law;
\nuse the Platform for fraud or other illegal actions;
\ndistribute false or offensive information.<\/p>\n
5. Content and Intellectual Property Rights<\/b>
\n5.1. By posting any content (texts, photos, videos, reviews), the User grants the Platform the right to use it within the framework of the operation of the service and marketing activities.
\n5.2. The User guarantees that he has all necessary rights to the posted content and that its use does not violate the rights of third parties.
\n5.3. The Platform has the right to delete content that violates this Agreement, the law or the rights of third parties.
\n5.4. All intellectual property rights to the Create4Me Platform, including (but not limited to):
\nsoftware, structure and design of the site and mobile application;
\nlogo, trademark, commercial name;
\ngraphic materials, texts, photos, videos, design elements;
\nany other objects of copyright and related rights –
\nbelong to the Platform and are protected by the legislation of Ukraine and international agreements.
\n5.5. It is prohibited without the prior written permission of the Platform:
\nto use the logo, corporate identity, brand or other elements of the Create4Me identity;
\nto copy, reproduce, publish or distribute any materials of the Platform (texts, photos, graphics, design, etc.);
\nto modify, decompile or otherwise interfere with the Platform software.
\n5.6. Any violation of the Platform’s intellectual property rights is considered a violation of this Agreement and may entail legal liability in accordance with applicable law.<\/p>\n
6. Personal data and cookies<\/b>
\n6.1. By using the Platform, the User consents to the processing of their personal data in accordance with the Create4Me Privacy Policy.
\n6.2. The Platform uses cookies to ensure the functioning and improvement of the service.<\/p>\n
7. Responsibility<\/b>
\n7.1. Users are personally responsible for the information they post and for the actions they take on the Platform.
\n7.2. The Seller is fully responsible for the goods, their quality, legality of sale, guarantees and returns.
\n7.3. The Buyer is responsible for the accuracy of the data, timely payment and compliance with the terms of purchase.
\n7.4. The Create4Me Platform is not responsible for any damages, harm or losses arising from the use of the Platform, except for cases expressly provided for by law.<\/p>\n
8. Force Majeure<\/b>
\n8.1. The Parties are exempt from liability for failure to fulfill obligations in the event of force majeure (war, natural disasters, failure of payment systems, hacker attacks, etc.).<\/p>\n
9. Dispute Resolution<\/b>
\n9.1. Disputes between Users are resolved by them directly.
\n9.2. If the dispute cannot be resolved through negotiations, it shall be subject to consideration in the courts of Ukraine at the location of the defendant.<\/p>\n
10. Final Provisions<\/b>
\n10.1. The Platform has the right to unilaterally change the terms of this Agreement.
\n10.2. Continued use of the Platform after changes shall constitute the User’s agreement to the new terms.
\n10.3. If any provision of this Agreement is declared invalid, the other provisions shall remain in force.
